That agenda, which includes changes to Appellate Body procedure limiting the discretion of judges and the creation of an alternative dispute resolution body on an opt-in basis runs the risk of entrenching the WTO’s shift away from a negotiating forum toward a kind of quasi-judicial body that produces more litigation than cooperation.
