The ITC and Patent Abuse: The Competition Issue No One Is Talking About

While the 117th Congress has spent months debating competition issues from the “big tech” antitrust bills to the CHIPS Act, lawmakers have overlooked a significant competition issue: reform of the U.S. International Trade Commission (ITC). In recent years, this little-known agency has been increasingly exploited by patent assertion entities (PAEs) that view the agency as a lower cost, more effective alternative to litigation in cases of patent infringement. The agency’s ability to issue injunction orders is a powerful threat that can induce many firms to settle. Even worse, while the ITC was initially established to quell unfair competition by foreign competitors, it is commonly used by PAEs to target domestic companies.

To answer this unique threat to competition and innovation, the R Street Institute is relaunching the ITC Policy Project, an initiative designed to provide the data, analysis and expertise needed to assess the ITC’s policies and the agency’s impact on the U.S. patent system.
