An Open Letter to Alan Dershowitz: We’ve heard this argument before
Many were shocked to hear the brazen legal argument that President Trump’s actions with regard to Ukraine are justified because he had the national interest in mind.
Some of our grandparents were among those in attendance to hear Fidel Castro’s chilling 1953 speech, “History Will Absolve Me,” during which he made this exact argument—almost verbatim. Castro was relentless in his pursuit of the greater good for Cubans. Every action he took, in his mind, was in the service of the Cuban people. If intention is the legal standard upon which to adjudicate claims of corruption or abuse of office, then neither Castro nor President Trump can be found liable.
The president has many times before ridiculed and criticized Maduro’s Venezuela. However, legal arguments like those presented yesterday directly employ the same rhetoric as Maduro. In a 2019 interview with ABC News, Maduro stated that the United States government is trying to “fabricate a crisis to justify political escalation.” We have heard this before and are hearing it now in the final days of Trump’s Senate impeachment trial.
To be perfectly clear, we in no way seek to compare President Trump to these authoritarian leaders in behavior or action.
Instead, we insist the Trump legal team recognize that its irresponsible legal arguments stem from dangerous precedent. We implore the team to abandon these Maduro- and Castro-esque arguments and present their case in a manner that both respects and upholds the values upon which this country was founded.

Muchos se sorprendieron al escuchar el argumento legal al que las acciones del presidente Trump con respecto a Ucrania están justificadas porque tenía en mente el interés nacional de los Estados Unidos. Para la mayoría de los críticos, esta estrategia parece audaz e incluso novedosa, pero la hemos escuchado antes.
Algunos de nuestros abuelos escucharon el discurso “La historia me absolverá” de Fidel Castro en 1953, durante el cual Castro hizo exactamente el mismo argumento, casi al pie de la letra. A sus ojos, Castro fue impecable en su búsqueda del bien mayor para los cubanos. Cada acción que tomaba, en su opinión, estaba al servicio del pueblo Cubano.
El presidente ha ridiculizado y criticado muchas veces a la Venezuela de Maduro. Sin embargo, los argumentos legales como los presentados ayer emplean directamente la misma retórica que Maduro. En una entrevista del 2019 con ABC News, Maduro declaró que el gobierno de los Estados Unidos estaba tratando de “fabricar una crisis para justificar la escalada política”. Hemos escuchado esto antes y lo estamos escuchando ahora en los días finales del juicio político en contra de Trump.
Para ser perfectamente claro, de ninguna manera estamos comparando al presidente Trump en comportamiento o acción con estos líderes autoritarios.
Por medio de esta carta insistimos a que el equipo legal de Trump recapacite respecto de que sus argumentos legales e irresponsables pueden ser ligados a precedentes peligrosos. Imploramos al equipo que abandone estos argumentos de Maduro y Castro y, en su lugar, presente su caso de una manera que respete y defienda los valores sobre los que se fundó este país.
