A couple of notable trends have recently emerged on the horizon in cybersecurity with potentially wide ranging ripple effects for governance and risk management. The Securities and Exchange Commission (SEC) has called for mandatory disclosure by companies of material cybersecurity risks, while the Cybersecurity and Infrastructure Security Agency (CISA) and the Office of National Cyber Director (ONCD) have advocated for industry to follow secure by design/secure by default principles and have explored potential liability for insecure software, among other efforts. This panel will bring together experts in policy, law and technology to explore the pros and cons of cybersecurity liability and disclosure requirements, including their interplay with cyber insurance. It will also address the key considerations for organizations for cyber risk management to meet their potential obligations.
