WASHINGTON (May 18, 2023)—Today, the U.S. Supreme Court (SCOTUS) issued opinions in two cases—Twitter, Inc. v. Taamneh et al. and Gonzalez et al. v. Google LLC. R Street signed onto amicus briefs in both cases.

In the first (Twitter), we joined the Center for Democracy and Technology, American Civil Liberties Union Foundation, Knight First Amendment Institute at Columbia University and Reporters Committee for Freedom of the Press in support of the petitioner, asking SCOTUS to “accord proper respect to the key First Amendment principles at stake and reverse the Ninth Circuit’s erroneous interpretation of the Anti-Terrorism Act (ATA).” Supreme Court Justice Clarence Thomas, delivering the opinion for a unanimous SCOTUS, said the plaintiffs’ allegations are “insufficient to establish that these defendants aided and abetted ISIS in carrying out the relevant attack.”

In the second case (Gonzalez), we joined the Cato Institute and Americans for Tax Reform in support of the respondent. SCOTUS remanded the case for the Ninth Circuit to consider the plaintiff’s complaint in light of the decision in Twitter.
