FRAND and Antitrust Debate: Pro-Implementer and Pro-SEP Holder Perspectives
Antitrust authorities in the United States and around the world have taken diverging approaches on the role of antitrust law in FRAND commitments in recent years, with the Qualcomm case showcasing the tension between the DOJ and FTC’s positions. This program will feature a debate between the dueling interests of SEP holders and implementers.
The speakers will address all sides of the issues and explore the future of antitrust litigation—and policy implications of different agencies’ and organizations’ approaches—for the next generation of FRAND controversies.
