Presumption of Innocence and Pretrial Detention
Pretrial detention is counter to the presumption of innocence demanded in the U.S. justice system, a report from the Square One Project argues. Only a limited set of circumstances can justify removing someone’s liberty before they are found guilty of a crime, and the report offers alternatives to incarceration that would to support communities and public safety. The MacArthur-supported report shares the current state of pretrial detention, the significance of presumption of innocence, and charts a more effective and humane path forward.
