Historically, senators have increasingly brought up abortion rights when questioning potential justices, especially Republicans’ nominees, according to a National Journal analysis of the libertarian-leaning R Street Institute’s database of Supreme Court hearing transcripts. What was once a nonissue in Justice John Paul Stevens’s hearing, just shy of three years after the Supreme Court issued the landmark Roe v. Wade decision, has become ubiquitous in senators’ probing of nominees’ judicial philosophy.
“Next week, you’re going to hear an awful lot about the ‘Ginsburg rule,’” said Anthony Marcum, a resident fellow at the R Street Institute specializing in the judiciary.
