R Street Institute has filed an amicus brief in Saint Regis Mohawk Tribe and Allergan, Inc. v. Mylan Pharmaceuticals Inc., Teva Pharmaceuiticals USA, Inc., and Akorn, Inc. which is currently before the United States Court of Appeals for the Federal Circuit. The brief opposes the pharmaceutical company Allergan’s attempt to use the sovereign immunity of the Mohawk Indian tribe to escape its patents being challenged before the patent trial and appeal board.
